Our workers’ compensation attorney, Keith Semple, has recovered tens of thousands of dollars in additional benefits for his clients after the Oregon Supreme Court issued its decision in Caren v. Providence. Keeping a close eye on current workers’ compensation issues, Keith brought several cases to the Court of Appeals for his clients. All of the cases involved reductions in permanent impairment compensation based on the assertion that some of the impairment was due to an unproven pre-existing condition. In Caren, the Court rejected that practice unless the relevance of any pre-existing conditions has been established. These cases have vindicated our clients’ right to due process on this issue. Keith is now helping lead the fight to make sure the administrative rules drafted in Salem are consistent with the Court’s decision.
